News Of The Tribe considers that confidentiality of personal data (or information) is of the utmost importance and undertakes to protect it in accordance with the laws and regulations in force on the protection of personal data.

Therefore, this Privacy Policy complies with relevant Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Additionally, we adhere to any applicable state and territory laws governing data protection and online privacy. This Privacy Policy supplements other notices and privacy policies that we might provide for specific purposes and is not intended to override them.

Welcome to News Of The Tribe, ("we," "our," or "us"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our mobile application (the "App"). By using our App, you agree to the collection and use of information in accordance with this policy.

2.  Information We Collect

We collect different types of information to provide and improve our services, including:

·       Personal Information: When you register, we may collect your name, email address, birth date and other necessary details as per what you fill in.

·       User-Generated Content: Any images, text, or other content you upload to the App.

·       Usage Data: Device IDS.

3.  How We Use Your Information

We use the collected information to:

·       Provide, operate, and improve our App.

·       Personalize user experience.

·       Process and display shared images and text.

·       Print your personal newspaper

·       Monitor and analyze usage trends.

·       Ensure compliance with our Terms and Conditions of Use and legal obligations.

4.  How We Share Your Information

We do not sell your personal information. However, we may share it in the following circumstances:

·       With Other Users (only) of the same Tribe: Your shared content may be visible to another member of your Tribe(s)

·       Service Providers: We may work with third-party services to enhance functionality.

·       Legal Requirements: If required by law or to protect our legal rights.

·       Business Transfers: If we undergo a merger, sale, or acquisition, your information may be transferred.

5.  Data transfer, retention & Security

We retain your information as long as necessary to provide our services. We implement security measures to protect your data, but no system is entirely secure. Users should be cautious about the content they share.

We are closely working with our service providers to ensure that they are compliant with Australian regulations.

You will be informed if your data must be disclosed in application of a law or regulation, or in compliance with a decision of a competent regulatory or judicial authority.

Personal data associated with users will be kept for the duration of the subscription to the News Of The Tribe service and for as long as necessary for the performance of your contract with us, for the fulfilment of our legal and regulatory obligations, and to enforce or apply our terms of use and other agreements, including for billing and collection purposes.

In the case of cancellation of a subscription without a request for deletion of the account, the personal data will be retained for a period of two (2) years and will remain accessible through the News Of The Tribe space. When the two years have elapsed, all active members of a Tribe will receive a communication, and all data will be deleted from our database.

In the case of cancellation of a subscription with a request for deletion of the account, the personal data will be deleted from our database and will no longer be accessible through the News Of The Tribe space.

Only posts sent to NOTT that were edited before the account is deleted will be kept in the previously generated PDFs in the Tribe space, and they will be only accessible for the Tribe.

The personal data of contacts and prospects, who do not create an account, are kept for two (2) years from the last contact of News Of The Tribe with the contact or prospect. At the end of this period the personal data will be deleted.

6.  Security and protection of personal data

Our services are hosted on Amazon Web Services (AWS) in the Asia Pacific (Sydney, Australia) data centre (ap-southeast-2 region). This ensures that all data remains securely stored within Australia unless specifically configured otherwise.

For communication security, all connections between our users and the server are encrypted using the TLS (Transport Layer Security) protocol, implemented through a valid TLS/SSL certificate. This guarantees that:

·       Data is encrypted end-to-end, preventing unauthorized access.

·       The server identity is authenticated, ensuring users connect to the genuine service.

·       The integrity of information is maintained, so no tampering can occur during transmission.

In short, all user interactions with our services take place over HTTPS, providing a secure and reliable communication channel.

The assurance and warranty programs in terms of security and personal data protection we have selected in AWS services have been subjected to strict SOC1, SOC2 and SOC3 compliance checks by independent international inspection organizations.

Data protection: The AWS infrastructure puts in place effective safeguards to keep users, contacts, and prospects confidential. All data is stored in highly secure AWS data centres.

To be more specific, the data that families exchange is encrypted with TLS certificate, between our users and the server.

AWS has security breach monitoring and a data breach notification process. It will take care of any confirmed breach of AWS systems and inform News Of The Tribe as soon as possible.

In the event of a personal data breach, News Of The Tribe undertakes to internally document the personal data breaches, as well as to notify the violations posing a risk to the rights and freedoms of individuals to the competent authority within seven days.

If the risks are high, the News Of The Tribe users concerned will also be notified without undue delay after News Of The Tribe being aware of the breach.

Only the News Of The Tribe teams have the right to process your personal data in connection with our services to you.

Access to your personal data by identified and authorized employees is only accessible through 1 (a single) IP address from News Of The Tribe registered office, or via a secure and registered VPN outside the company's registered office.

7.  Service Providers

We use the services of various third parties to facilitate provision of our services, such as hosting and printing your personalized newspaper.

We may share your personal data with these service providers when they are subject to obligations in accordance with this Privacy Policy and any other appropriate privacy (as GDPR) and security measure, provided that such third parties use your personal data only on our behalf and according to our instructions.

8.  Your Rights & Choices

The person whose personal data is collected has the following associated rights:

·       To ask the data controller for access to his or her personal data, to require correction or deletion of personal data, or to demand limitation of processing related to the person in question (hereinafter the ‘data subject’),

·       Regarding the portability of his or her data,

·       To not be the subject of individual decision-making based exclusively on automated

Upon receipt of a valid request by email, it shall be processed without undue delay. Occasionally it could take us longer than thirty (30) working days if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure the right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

10.  Use of cookies

Under the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), there are no explicit laws specifying a maximum retention period for cookies. However, organizations must ensure that personal information collected via cookies is not retained longer than necessary. We adhere to industry best practices by:

·   Allowing users to manage their cookie preferences.

·   Providing an option to delete stored cookies.

Users may adjust their browser settings to refuse cookies or alert them when cookies are being sent. However, some parts of the App may not function properly without cookies.

Our site uses cookies provided by Google Analytics and Google Tag Manager. Google Analytics and Google Tag Manager process the data mentioned under the provisions set out in their privacy policy: https://support.google.com/analytics/answer/6004245?hl=en#infocollect.

The data processed by Google Analytics includes the IP address of devices used to view the site, but they are not sent to us.

Cookies may be used for statistical purposes, and in particular to optimize the services News Of the Tribe provides to its users, this includes processing information concerning frequency of access, the personalization of pages, as well as operations carried out and the information consulted.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate data regarding your use of the Site or Application to calculate the percentage of users accessing a specific Site or Application feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Privacy Policy.

On the Application or the Site, we never ask for so-called sensitive data (racial or ethnic information, political opinions, religious or philosophical opinions, trade union membership, health, sexual orientation) and we do not advise you to enter such data when using the Site or the Application. However, if you choose to include in the free comments spaces any so-called sensitive data (including health data such as information about a disability), they will be transmitted, as they are, under your sole responsibility and on your own initiative, to our services or partners in order to process your request.

Processing of personal data implemented by News of The Tribe serves explicit, legitimate and predetermined purposes, and it is intended for management of subscriptions to the News Of The Tribe service as well as management of the relationship with our users and for sending transactional and marketing messages. This processing is aimed at creating and ensuring the proper management of subscriptions for the managers, users and beneficiaries of News of the Tribe services.

News Of The Tribe strives to collect and process only data strictly necessary for the purposes of the implemented processes.

News of the Tribe may send you marketing messages. You can oppose this at any time by clicking on the unsubscribe link at the bottom of each email or by contacting News Of the tribe ("Contact Us").

Legal basis:

This processing is necessary for the performance of the contract to which the data subject is party or for the execution of pre-contractual measures taken at the request of the latter. It is based on Article 6 (1) (b) of the GDPR. The request for data with a contractual nature: the data subject is obliged to provide this data if he or she wishes to enjoy use of our products or services. If the person concerned does not provide the data, they will not be able to subscribe to a News Of The Tribe subscription and will not have access to the service.

Change of purpose:

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

The processing of personal data is intended for the management of the relationship with our contacts and prospects. This process is aimed at communicating information about our products and services to the person concerned, following a specific request via our contact and invitation forms or by email.

Legal basis:

This processing of personal data is based on the consent of the data subject. The data subject is not obliged to provide this data.

If the data subject does not provide the data or withdraws consent to the data processing, he or she will not be able to receive information from our organization, our products and services.
